1. Permitted Use

Circus Oz has provided digital streams of the videos on this site for your personal use and enjoyment. Please feel free to share links to this site and the videos contained on this site with your friends and family via social media such as facebook, twitter and other blogging services.

We do not give you permission to use the videos in any commercial context, or to create copies of the videos or the music contained within the videos, or to do anything with the videos or the music that might constitute copyright infringement under the Copyright Act 1968 (Cth).

We do not give you permission to copy any of the music, choreographic routines, performance routines, or any other artistic works contained within the videos (“Content”), or to use the Content in any commercial context, or to do anything with the Content which might constitute copyright infringement under the Copyright Act 1968 (Cth). You agree not to disable or in any way interfere with any security-related or watermarking features of the Living Archive.

Any unauthorised use of the videos and/or the Content will constitute a breach of these terms and conditions and may also constitute a breach of copyright and other applicable laws.

If you wish to use any of the content on this site outside the parameters of the permitted uses outlined above, permissions may be possible by contacting us at 9646 8899 or admin@circusoz.com.au

2. Music ownership

Ownership of music contained in the videos on this site

All of the compositions and recordings (“Music”) contained in the videos on this site are either (i) owned by Circus Oz (including all copyrights and other applicable intellectual property rights to such compositions and recordings), or (ii) have been licensed from their respective owner(s) by Circus Oz, such that Circus Oz has the full authority to use and include the Music on this site.

Circus Oz has made its best endeavours to clear the use of all of the Music contained in the videos on this site and to obtain the permission of all relevant copyright owners where content is not owned by Circus Oz. If you believe you own copyright in any of the Music contained in the videos on this site and your permission has not been sought, please contact us at 9676 0300 or admin@circusoz.com.au

3. Registration

To make comments or collections to the Living Archive you need to register by providing a user name, password, and valid email address. You must provide complete and accurate registration information to the Living Archive. If your information changes, please update it as we like the circus community to stay as our mates.

4. Appropriate Content

The Circus Oz Living Archive brings the glory, mishap, splendour and ridicule of our history back to the living now. It is made more valuable by your input, your peculiar memories, your experience as either a performer or an audience member. We have designed the site so you can, will, or possibly can’t resist adding your story to ours. However, we ask you do so in a spirit of respect for those living, past, still performing, or just watching, ensuring we uphold the principal of equality and a fair go for all.

Circus Oz reserves the right to moderate this content and remove posts that contain offensive, crude, hateful, derogatory, prejudice, private or defamatory comments. Should your post be removed, please consider this as a warning. Further comments in the same tone will result in the user being banned from participating in the Living Archive.

If you have published a particularly stellar comment, we’d love to have the opportunity to share this to our wider mob. You accept that any content posted by you on the Living Archive is in the public domain and not confidential, and that it may be used by Circus Oz for further promotion of the Living Archive.

5. Project Partners

The Circus Oz Living Archive: developing a model of online digital engagement for the performing arts.

Circus Oz is collaborating with RMIT University, the Australian Research Council, La Trobe University, the Australia Council for the Arts and the Victorian Arts Centre Trust (Performing Arts Collection). The Australian Research Council and the Australia Council have funded the project.

This website represents work undertaken by the researchers listed above as part of their research on the Circus Oz Living Archive project, led by RMIT University in partnership with Circus Oz, the Australian Research Council, La Trobe University, the Australia Council for the Arts and the Victorian Arts Centre Trust (Performing Arts Collection). The Australian Research Council and the Australia Council have funded the project. Any contributions made as comments within this site may be used as part of this research/project and included in appropriate research publications, and associated documents. All such comments will be appropriately cited.

The researchers and RMIT reserve the right to remove any material from the site that is inconsistent with or contravenes the RMIT Electronic communications policy.

6. Cultural Warning

Circus Oz warns Aboriginal and Torres Strait Islander viewers that the Living Archive may contain images and voices of deceased persons.

7. Appearing in the Living Archive

Circus Oz has made the best endeavours to contact all the performers that appear in these videos. If we have not been able to find you we would still love to hear from you, either through your comments and stories or you can contact Circus Oz directly. The conversation is still open if you have any questions. This is a living, breathing archive and the design is flexible.

If you were in the audience and appear in these videos please contact us if you have any questions. Please notify Circus Oz is you think there is a copyright issue (music or otherwise). Our intention is for this to be a wonderful, extraordinary and lawful research and historical tool for all people.

8. Indemnity

By accepting these terms and conditions, you agree to indemnify and hold harmless Circus Oz and the Living Archive project from and against all claims, demands, losses, causes of action, damage, law suits, judgments, including attorneys’ fees and costs, arising from your use of and/or access to the Living Archive (including any comments or content posted by you on the Living Archive), any breach by you of these terms and conditions, or any alleged or actual violation by you of any third party right (including without limitation any copyright, intellectual property or privacy rights).

Circus Oz reserves the right to change and amend these terms and conditions as necessary.
